Welcome to TheSimplifiedTech. These Terms of Service ("Terms") govern your access to and use of the TheSimplifiedTech website, platform, and services (collectively, the "Service") operated by TheSimplifiedTech ("we", "us", or "our").

  • Interactive scenarios and interview preparation resources
  • AI-powered learning assistance features
  • Progress tracking and gamification features

4. Subscriptions and Payments

4.1 Free and Paid Plans

The Service offers both free and paid subscription plans ("Pro"). Free users have access to a limited set of features. Pro subscribers gain access to additional content, features, and capabilities as described on our pricing page.

4.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or yearly) through our payment processor. By subscribing to a paid plan, you authorize us to charge your chosen payment method for the applicable subscription fees.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to Pro features until the end of your current billing period. No refunds will be issued for partial billing periods unless required by applicable law.

4.4 Refunds

5. Acceptable Use

You agree not to use the Service to:

  • AI-generated content is provided for educational purposes and may not always be accurate or complete
  • You should not rely solely on AI-generated content for professional decisions
  • We are not responsible for any actions you take based on AI-generated content
  • Your interactions with AI features may be processed by third-party AI providers subject to their own terms and privacy policies

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. Educational content is provided for informational purposes and does not constitute professional advice. We make no guarantees regarding career outcomes, employment, or certifications.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THESIMPLIFIEDTECH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless TheSimplifiedTech and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, conducted in India. You agree to waive any right to a jury trial or participation in a class action.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheSimplifiedTech regarding the Service, and supersede all prior agreements and understandings.
